Who can make a will under Thai law?
Any person who is at least 15 years old and of sound mind may make a will in Thailand. The Civil and Commercial Code sets out specific forms — the most common being a holograph will (written entirely by hand by the testator) and a witnessed will. We discuss which form best suits your circumstances during the consultation.
What happens to an estate if there is no will?
When someone dies intestate (without a will) in Thailand, the estate is distributed among statutory heirs in a set order defined by the Civil and Commercial Code. Spouses, children, parents, siblings, and other relatives each have defined priority. The court appoints an administrator to manage the distribution. We can walk you through how this applies to the specific estate.
How long does probate typically take in Thailand?
A straightforward probate application in Thailand — where the will is clear and the heirs are in agreement — can be completed within three to six months. Matters involving disputes, missing heirs, or complex assets may take longer. We give you a realistic timeframe estimate at the outset based on the specific details of the estate.
Can a foreign national inherit property in Thailand?
Foreign nationals may inherit assets in Thailand, though certain restrictions apply to land ownership. Depending on the asset type, a foreign heir may be required to sell the land within a specified period, or the inheritance may take the form of proceeds rather than the title itself. We advise on the correct steps to protect the heir's interests within Thai law.
